What is a foster family from a legal perspective?

Traditionally, family law was built on two foundations: biological filiation and adoption. However, social reality moved beyond those categories long ago.

The Supreme Court of Justice has recognized that family relationships may arise from care, cohabitation, and permanent solidarity, even when there is no biological or adoptive bond. This is known as a foster family.

Case law has stated that upbringing constitutes an autonomous family status, built through permanent and public conduct involving protection, affection, support, and parental responsibility.

In practical terms, affection or occasional help is not enough. What is analyzed is whether a person stably assumed the true role of father or mother toward a minor.

When does a foster child relationship exist?

Not every close relationship legally constitutes a foster family. Judges typically require strong evidence and several concurrent elements for recognition.

Criteria that usually prove a foster family

Taking care of the minor as a father or mother would

The third party must have performed functions proper to a father or mother, both economically and emotionally.

Weakness or absence of the biological bond

Case law usually examines whether the biological parents were absent, failed to fulfill their duties, or maintained a precarious relationship with the minor. The complete nonexistence of the bond with the biological parents is not required.

Social and family recognition

The close environment, educational institutions, relatives, and community must have publicly identified that relationship as a true parent-child relationship.

Permanence over time

Martha Patricia Guzmán Álvarez), ha sido especialmente cuidadosa en evitar que cualquier relación afectiva se convierta automáticamente en una fuente de  derechos sucesorales. Por ello, si los progenitores mantuvieron presencia efectiva, cuidado constante y cumplimiento de sus deberes, la declaratoria de crianza puede resultar improcedente. En definitiva, lo determinante es el rol: pueden existir llamadas, visitas o regalos ocasionales de los padres biológicos, pero la prueba debe demostrar quién cumplió frente al menor un verdadero rol de padre o madre.

Durante años este fue un vacío legal: en la Sentencia C-085 de 2019 (M.P. Cristina Pardo Schlesinger), la Corte Constitucional se declaró inhibida para incluir a los hijos de crianza en el primer orden hereditario del artículo 1045 del Código Civil, al estimar que se trataba de una omisión legislativa que correspondía resolver al Congreso. Ese vacío lo llenó la Ley 2388 de 2024, que reconoció a los integrantes de la familia de crianza la calidad de herederos o legatarios en la sucesión testada o intestada (artículo 7). Eso sí, el vínculo se traba solo frente a quien ejerció la crianza —el padre, la madre o los abuelos de crianza—: con quien cumplió el rol de cuidado, no con toda su familia, como sí sucede en la adopción.

En determinados casos, los hijos de crianza pueden llegar a concurrir junto con hijos biológicos o adoptivos dentro del primer orden hereditario —como lo reconoció la Corte Suprema en la sentencia SC2430-2025 (M.P. Fernando Augusto Jiménez Valderrama), la primera que declaró a un hijo de crianza con derechos herenciales—, un desarrollo reciente que ha generado controversias familiares y litigios complejos. How is a foster-care family (familia de crianza) legally formalized?

La Ley 2388 de 2024 contempló inicialmente que el reconocimiento se hiciera ante notario o ante juez de familia (artículo 3). Sin embargo, la Corte Constitucional declaró inexequible la vía notarial en la Sentencia C-506 de 2025 (M.P. Vladimir Fernández Andrade), por tratarse de una función jurisdiccional que exige valoración probatoria. Hoy, en consecuencia, el reconocimiento del hijo de crianza, con plenos efectos jurídicos, solo puede hacerse ante un juez de familia. Se tramita como un proceso de jurisdicción voluntaria —previsto en el Código General del Proceso, Libro III, Sección IV—, que se caracteriza por la ausencia de pleito; si surge un conflicto por dirimir, el asunto se encauza por el proceso que corresponda.
